Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Karegivv platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

1. Definitions

"Platform" refers to the Karegivv website and mobile applications
"Services" refers to all services provided through the Platform
"User" refers to any person who accesses or uses the Platform
"Caregiver" refers to healthcare professionals offering services through the Platform
"Patient" refers to individuals seeking care services through the Platform
"We," "Us," "Our" refers to Karegivv

2. Eligibility

To use our Platform, you must:

Be at least 18 years of age
Have the legal capacity to enter into binding contracts
Not be prohibited from using the Platform under applicable laws
Provide accurate and complete registration information
For caregivers: possess valid licenses and qualifications required by law

3. User Accounts

Account Creation

You must create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Caregiver Obligations

If you register as a caregiver, you agree to:

Provide accurate information about your qualifications and experience
Maintain valid licenses and certifications required by law
Provide professional and compassionate care services
Comply with all applicable healthcare laws and regulations
Maintain appropriate insurance coverage
Report any incidents or concerns promptly
Respect patient privacy and confidentiality
Honor scheduled appointments or provide adequate notice of cancellation

5. Patient Obligations

If you register as a patient, you agree to:

Provide accurate information about your care needs
Treat caregivers with respect and professionalism
Provide a safe environment for care services
Pay for services as agreed
Provide adequate notice of appointment cancellations
Report any concerns or issues promptly

6. Acceptable Use

You agree not to:

Use the Platform for any illegal purpose
Violate any applicable laws or regulations
Infringe on the rights of others
Transmit harmful or malicious code
Attempt to gain unauthorized access to the Platform
Interfere with the proper functioning of the Platform
Harass, abuse, or harm other users
Impersonate any person or entity
Collect user information without consent
Use automated systems to access the Platform

7. Payments and Fees

Service Fees

Karegivv may charge fees for certain services. All fees will be clearly disclosed before you complete a transaction. Fees are non-refundable except as required by law.

Payment Processing

Payments are processed through third-party payment processors. You agree to comply with their terms and conditions.

Cancellation Fees

Cancellation fees may apply based on the timing of cancellation. Please review our cancellation policy before booking appointments.

8. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, images, and software, are the property of Karegivv and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our prior written permission.

9. Disclaimers

Platform as Intermediary

Karegivv acts as an intermediary platform connecting patients with caregivers. We do not provide healthcare services directly and are not responsible for the quality of care provided by caregivers.

No Warranties

The Platform is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

Medical Disclaimer

The Platform does not provide medical advice. Always consult with qualified healthcare professionals for medical concerns.

10. Limitation of Liability

To the maximum extent permitted by law, Karegivv shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform.

11. Indemnification

You agree to indemnify and hold harmless Karegivv and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or violation of these Terms.

12. Dispute Resolution

Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the laws of Kenya. You waive your right to participate in class action lawsuits.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
